⚠️ Important: By using Nyxa, you confirm that you are at least 18 years of age and agree to these terms in full.
1. Acceptance of Terms
By accessing or using Nyxa ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. We reserve the right to update these terms at any time, and continued use of the Platform constitutes acceptance of any changes.
2. Age Requirement
You must be at least 18 years of age to use Nyxa. By creating an account, you confirm that you meet this age requirement. The Platform contains adult content (NSFW) that is strictly for adults only. We reserve the right to terminate accounts of users found to be under 18 years of age.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information. One person may not maintain multiple accounts for the purpose of abusing free quotas or referral programs.
4. Acceptable Use
You agree not to use the Platform to: • Generate, distribute, or promote content involving minors in sexual situations • Harass, threaten, or harm other users • Attempt to hack, disrupt, or damage the Platform's infrastructure • Violate any applicable local, national, or international laws • Impersonate other users or public figures with malicious intent • Use automated tools to scrape or abuse the Platform's services • Abuse the referral program or credit system through fraudulent means
5. AI-Generated Content
Nyxa uses artificial intelligence to generate responses and media. All AI-generated content — including text, images, voice, stories, and posts — is entirely fictional and does not represent real people, events, or entities. We are not responsible for the accuracy, completeness, or appropriateness of AI-generated content. Users are solely responsible for how they use and interpret AI-generated content.
6. Adult Content & Nyxa Companions
The Platform allows adult content for verified adult users only. By enabling adult content features or creating/chatting with adult or Nyxa characters, you confirm you are 18+ and consent to viewing such material. Free users may chat with public adult characters at their own discretion. Pro users may create adult characters, Nyxa companions, and adult group chat rooms. Nyxa companions are AI characters designed for emotional and intimate interaction. All interactions are fictional and simulated. You agree not to share adult content generated on the Platform with minors. We reserve the right to restrict or remove adult content at our discretion.
7. Group Chat Rooms
Pro subscribers may create group chat rooms and invite AI characters and other users. Room owners are responsible for setting appropriate rules and moderating their rooms. Adult group rooms are restricted to Pro users only. Free users may join normal (non-adult) public group rooms but may not create rooms. We reserve the right to remove rooms that violate these terms.
8. Social Media Character Import
The Platform offers a feature to generate AI characters inspired by public social media profiles from X (Twitter), Instagram, and TikTok. This feature is available to both Free and Pro users with credits. You may only import from publicly available profiles. Generated characters are fictional AI personas — they are not affiliated with, endorsed by, or representative of the real person behind the imported profile. You agree not to use imported characters to defame, harass, or impersonate real individuals. We reserve the right to remove any character found to be used in a harmful or misleading manner.
9. Credits and Payments
Credits purchased on Nyxa are non-refundable unless required by applicable law. Credits have no cash value and cannot be transferred between accounts or withdrawn. We accept payments via major cryptocurrencies including but not limited to Bitcoin (BTC), Ethereum (ETH), USDT, BNB, USDC, and TRX. Payments are processed on-chain — credits are added automatically after blockchain confirmation. Subscription plans auto-renew unless cancelled before the renewal date. We reserve the right to modify pricing with reasonable advance notice. $1 USD equivalent = 1,000 credits. Exchange rates are calculated at time of payment.
10. Referral Program
The referral program allows users to earn credits by inviting others to the Platform. Credits earned through referrals can only be used within the Platform and cannot be withdrawn as cash. You earn credits when referred users subscribe to Pro, and again on each renewal. We reserve the right to modify or terminate the referral program at any time. Fraudulent referral activity — including self-referrals or fake accounts — will result in immediate account termination and forfeiture of all earned credits.
11. Intellectual Property
Characters and content you create on Nyxa remain your intellectual property. By making content public, you grant Nyxa a non-exclusive, royalty-free license to display that content on the Platform. The Nyxa name, logo, and Platform design are proprietary and may not be used without written permission. AI-generated content produced by the Platform's models does not carry copyright ownership claims by Nyxa.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy. We are committed to protecting your privacy — we do not require personal information to register or pay. Payments are made via cryptocurrency and are anonymous by design. Private Mode conversations are not stored on our servers. Please review our Privacy Policy to understand our full data practices.
13. Disclaimer of Warranties
The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or that the Platform will meet your specific requirements. AI responses, stories, images, and voice outputs are generated automatically and may occasionally be inaccurate, inconsistent, or unexpected. Free users may experience queue delays during peak server load — this is not a service failure.
14. Limitation of Liability
To the maximum extent permitted by law, Nyxa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for any losses arising from cryptocurrency payment volatility or blockchain delays.
15. Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms. Upon termination, your right to use the Platform ceases immediately and unused credits are forfeited. You may delete your account at any time through the account settings. Termination does not entitle you to a refund of any purchased credits or subscription fees.
